Platform Terms of Service

1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of the MarStack platform, website, and related services (collectively, the “Platform”) operated by PawSites, LLC (“MarStack,” “we,” “us,” or “our”). By accessing or using the Platform, you agree to these Terms and our Platform Privacy Policy. If you do not agree, do not use the Platform.
2. The Platform
MarStack provides marketing attribution and martech diagnostic tools, including:
- Site Audit — automated checks of tags, campaign parameters, forms, phone numbers, and related signals on URLs you submit
- Stack Editor — tools to document and export your marketing technology stack
- Attribution Map — reporting views powered by Google Analytics when you connect an authorized Google account
- Accounts and workspaces — optional registered features, team access, billing, and industry-specific modules where enabled
We may add, change, or discontinue features at any time. Diagnostic results are provided for informational purposes and may be incomplete or inaccurate depending on site configuration, consent banners, ad blockers, and third-party changes.
3. Eligibility and Accounts
You must be at least 16 years old and able to form a binding contract to use the Platform. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at info@marstack.com if you suspect unauthorized access.
Information you provide must be accurate and kept current. We may suspend or terminate accounts that violate these Terms or pose a security risk.
4. Acceptable Use
You agree not to:
- Use the Platform unlawfully or in violation of third-party rights
- Submit URLs or run audits against sites you do not own or lack explicit permission to test
- Attempt to bypass guest limits, authentication, rate limits, or security controls
- Reverse engineer, scrape, or overload the Platform except as allowed by law
- Upload malware, interfere with other users, or harvest data without authorization
- Misrepresent affiliation with MarStack or any third party
- Use diagnostic output as legal, compliance, or professional advice without independent verification
We may investigate violations and cooperate with law enforcement where appropriate.
5. Guest and Registered Use
Some features (such as limited Site Audits) are available without an account. Guest use is subject to usage caps and technical restrictions we publish or enforce in the product. Registered accounts may access additional features, integrations, and workspace tools subject to your subscription plan.
6. Google Analytics and Third-Party Services
Attribution Map and related features rely on Google APIs and your Google account permissions. Your use of Google services is subject to Google’s terms and policies. We are not responsible for Google’s availability, accuracy, or changes to their APIs. Other third-party tools linked from the Platform are governed by their own terms.
7. Business Workspaces and Customer Data
If you use the Platform on behalf of an organization, you represent that you have authority to bind that organization. You are responsible for configuring access roles, obtaining consents from your staff and end users, and complying with privacy laws applicable to data you load into the workspace. Where HIPAA or similar rules apply, you are responsible for determining scope and executing required agreements with us.
8. Subscriptions and Payment
Paid plans, if offered, are billed according to the pricing and billing cycle shown at purchase. Fees are generally non-refundable except where required by law or stated in writing. We may change prices with advance notice for renewal periods. Failure to pay may result in suspension or termination of paid features.
9. Intellectual Property
The Platform, including software, design, trademarks, and documentation, is owned by MarStack or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Platform for your internal business purposes in accordance with these Terms.
You retain ownership of content you submit. You grant us a license to host, process, and display that content solely to operate and improve the Platform.
10. Disclaimers
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that audits will detect every tracking issue, that Attribution Map data matches your internal analytics, or that the Platform will be uninterrupted or error-free. You are solely responsible for decisions made based on Platform output.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARSTACK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
12. Indemnification
You will defend, indemnify, and hold harmless MarStack from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Platform, content you submit, violation of these Terms, or violation of any law or third-party right (including scanning websites without permission).
13. Termination
You may stop using the Platform at any time. We may suspend or terminate access immediately for breach of these Terms, risk to the Platform or other users, or as required by law. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive termination.
14. Governing Law and Disputes
These Terms are governed by the laws of the United States and the State of Vermont, without regard to conflict-of-law rules. Exclusive venue for disputes arising from these Terms lies in the state or federal courts located in Vermont, unless applicable law requires otherwise.
15. Changes to Terms
We may modify these Terms by posting an updated version on this page and updating the “Last updated” date. Continued use after changes become effective constitutes acceptance. Material changes may be communicated through the Platform or by email where appropriate.
